Here Is The Law Regarding Drink While Boating

Much like driving a vehicle on land you can have a drink and drive (or boat), but once you go over .08 BAC you will find yourself in trouble, and that rule applies to those driving a boat as well.

Montana Code § 23-2-523(2) states the following:

A person may not operate a motorboat, including a sailboat propelled by a motor of any kind, or manipulate waterskis, a surfboard, or a similar device attached to a motorboat while under the influence of alcohol, drugs, or a combination of the two.
